These Terms of Service ("Terms") govern the ENKORE platform, operated by Fanbase Africa (Pty) Ltd ("ENKORE", "we", "us", or "our"), a company incorporated in the Republic of South Africa and based in Cape Town. The platform lets Christian, Gospel, and Praise musicians, worship teams, and churches ("Musicians") upload, stream, and sell their music, tickets, and merchandise directly to the fans who support them ("Fans"), through the ENKORE website and any related applications (together, the "Platform").
By creating a Musician Store, uploading Music, or streaming, downloading, or purchasing Music, tickets, or merchandise through the Platform, you agree to be bound by these Terms.
The Platform is built exclusively for Christian, Gospel, and Praise music. ENKORE may decline or remove any Musician, Store, or Music that is inconsistent with this focus, in its reasonable discretion.
A DJ/Producer may join without released music of their own, but must run Christian events and play Christian music. A DJ/Producer sells only mixes, sets or productions they have the right to sell, and ENKORE may decline or remove a DJ/Producer whose events or music do not fit this focus.
You must be at least 18 years old to open a Musician Store. Fans must be at least 18 years old, or have parental/guardian consent, to create an account or make a purchase.
If you are acting on behalf of a group, worship team, or church (a "Musician Entity"), you confirm that you are authorised to bind that Musician Entity, and any musicians it represents, to this Agreement.
You must own or control all rights in any Music you upload, including the sound recording and the underlying composition and lyrics. Cover songs, samples, or arrangements of someone else's composition may only be uploaded if you hold a written licence or authorisation from the rights holder covering both the sound recording and the composition — this applies whether or not you charge for the Music.
You are responsible for correctly identifying, at the point of upload, whether any songwriter on your Music is affiliated with a Collecting Society such as SAMRO or CAPASSO, and for keeping that information accurate and up to date.
You retain all ownership of your Music, including your sound recordings, compositions, lyrics, artwork, and any associated metadata ("Artworks"). ENKORE does not acquire ownership of your Music by you uploading it to the Platform.
By uploading Music, you grant ENKORE a worldwide, non-exclusive, royalty-free licence to host, reproduce, stream, distribute, publicly perform, and display your Music and Artworks solely to operate, market, and promote the Platform and your Store, and to allow Fans to stream, download, and purchase your Music as you have configured it. This licence continues only for as long as your Music remains on the Platform, except to the extent needed to fulfil transactions already completed, honour Fans' prior downloads, or comply with law.
You also grant ENKORE a limited licence to use your name, likeness, and Store branding to promote your Music and the Platform.
ENKORE will not use, and will not permit any third party to use, your Music to train a machine-learning or AI model of any kind without your express written permission. This commitment applies regardless of any broader rights described elsewhere in this Agreement.
You warrant that your Music and Artworks do not infringe the intellectual property, privacy, or publicity rights of any third party, and that using or exploiting them as contemplated by this Agreement will not give rise to any claim against ENKORE.
5.1 Musician plans — ENKORE offers Musicians a choice of plans for the Platform, which may include a monthly or periodic subscription fee and/or a percentage-based service fee on Digital Transactions ("ENKORE Fee"), as set out on the Platform and in your onboarding agreement. Every plan carries the same annual cap on the total ENKORE Fee we collect from you: R50,000.00 (~US$3,750.00) if you sell as a solo musician, or R100,000.00 (~US$7,500.00) if you sell as a band, choir or other group act. The cap applies over a rolling 365 days, not a calendar year — once we have collected that much from you within the trailing 365 days, the ENKORE Fee is 0% for the rest of that period.
5.2 Pricing — You set the price of your Music, tickets, merchandise, and Musician Subscriptions, subject to any Platform minimums. You may change pricing at any time, but a price change does not affect a Fan's Musician Subscription until their next renewal.
5.3 Collecting Society payments — Where your Music includes compositions written by a songwriter affiliated with SAMRO, CAPASSO, SAMPRA, or another Collecting Society, ENKORE may deduct and remit the applicable share of revenue to that society on your behalf, in accordance with its published rates. You are responsible for correctly identifying songwriter affiliations; if you misidentify a songwriter as unaffiliated and ENKORE is subsequently required to pay a Collecting Society, ENKORE may recover that amount from your future payouts.
5.4 Payouts — You will receive the price paid by the Fan, minus the ENKORE Fee, any applicable Collecting Society share, payment-processor charges, and applicable tax, on the payout schedule for your plan, paid to your nominated bank account.
6.1 Streaming, downloads, and purchases — Fans may stream previews of Music free of charge and purchase Music as a download, tickets, or merchandise, and/or take out a Musician Subscription, through the Platform. Payment is accepted through PayFast, Kyshi (whose checkout is secured by Paystack) and PayPal, as well as any other methods added from time to time.
6.2 Musician Subscriptions — A Musician Subscription renews automatically at the end of each billing period at the then-current price, unless you cancel before the renewal date. Cancellation takes effect at the end of the current billing period; we do not provide refunds or credits for the unused portion of a period already paid for, except as required by law.
6.3 Refunds and availability — Because Digital Transactions largely involve digital content, sales are generally final once a download or stream has begun, except where required by the Consumer Protection Act or where what you receive is corrupted, materially incomplete, or not as described — in which case contact us with proof of purchase and we will work with the relevant Musician to resolve it, which may include a replacement or a refund at our discretion. Tickets and merchandise orders follow the cancellation and refund terms shown at the time of purchase.
Merchandise is made in Port Elizabeth and fulfilled by ENKORE under the For His Glory brand, not by the Musician. We use Bob Go for South African deliveries, shipped from The Courier Guy at Fig Tree in Walmer, and TUNL for international orders, shipped from TUNL's Cape Town headquarters, which arrive in 3 to 14 days. South African deliveries are free and take 7 to 9 working days. Musicians do not handle packing, posting or delivery.
If ENKORE receives a valid copyright takedown notice, or is otherwise required by law to remove Music, we may deny continued access to that Music, including to Fans who previously purchased it, and no refund will be owed except where required by law. We encourage you to promptly download any Music you purchase so that you retain your own copy.
All Music and related Artworks must comply with this policy. ENKORE may remove Music, without liability, that it believes violates this policy, applicable law, or the Christian, Gospel, and Praise focus of the Platform.
Unlike mainstream streaming platforms, ENKORE is built to help Musicians connect with and understand the Fans who support them. When a Fan streams, downloads, or subscribes to a Musician's Music, or buys a ticket or merchandise, relevant Supporter Information may be shared with that Musician so they can communicate with the Fan about their music and ministry and build a direct relationship with them. See our Privacy Policy for how we handle personal information more broadly.
Musicians who receive Supporter Information must handle it lawfully and securely under POPIA, and use it only to connect with and serve their supporters — not to sell, rent, or trade it to unrelated third parties. Any Musician communications sent using Supporter Information must comply with applicable e-mail and messaging marketing laws and include a working opt-out mechanism, which must be honoured promptly.
8.1 Your community is yours — The community a Musician builds on the Platform, and the Supporter Information that comes with it, belongs to that Musician, not to ENKORE. ENKORE will not lock it in the Platform. On request, and when a Musician leaves the Platform, ENKORE will hand that Supporter Information over to the Musician as it is held at the time, in a common format such as a spreadsheet.
8.2 Fans keep their rights — This does not take away any right a Fan has under POPIA. A Musician receives a Fan's contact details only for the channels (such as email, SMS or WhatsApp) that the Fan agreed to be contacted on, and only while that agreement stands. Where a Fan has deleted their account or their data, or withdrawn their agreement, before a hand-over, that Fan's data is left out of it. ENKORE is the responsible party under POPIA for Supporter Information. After a hand-over, the Musician must keep handling it lawfully and securely, use it only as these Terms allow, and honour any later request from a Fan to stop contact or delete their data.
The Platform integrates with third-party payment processors PayFast, Kyshi (whose checkout is secured by Paystack) and PayPal. Your use of those services is subject to their own terms, and ENKORE is not responsible for their acts or omissions, though we will work in good faith to help resolve issues that affect your Digital Transactions.
Either party may terminate this Agreement, or a Musician's or Fan's participation, on reasonable notice. ENKORE may suspend or remove access immediately where necessary to prevent harm, comply with law, or address a material breach of this Agreement, including the Content Policy.
On termination, Digital Transactions already completed are unaffected, and Fans retain access to Music they have already downloaded to their own devices. A Musician who leaves may ask for their community to be handed over as set out in Section 8.1. Provisions that by their nature should survive termination — including intellectual property, warranty disclaimers, indemnification, and limitation of liability — continue to apply.
Nothing in this Section limits any liability that cannot lawfully be limited under South African law, including under the Consumer Protection Act, or excludes any statutory warranty, guarantee, or right you have as a consumer.
Subject to the foregoing, the Platform is provided on an "as available" basis, and ENKORE does not warrant that it will be uninterrupted or error-free. ENKORE's aggregate liability arising out of this Agreement, other than in respect of death, personal injury, fraud, or liability that cannot be excluded by law, will not exceed the amount you paid to ENKORE in the twelve (12) months before the claim arose.
Because ENKORE facilitates but is not a party to the underlying sale between a Musician and a Fan, ENKORE is not responsible for resolving disputes between them about the Music, ticket, or merchandise itself, though we will assist in good faith where an issue arises from our own Platform or processing error.
You agree to indemnify ENKORE, Fanbase Africa (Pty) Ltd, and their officers, employees, and agents against claims, losses, or costs (including reasonable legal fees) arising from your breach of this Agreement, your Music or other content, or your unlawful use of the Platform, except to the extent caused by ENKORE's own negligence or breach of this Agreement. This includes claims from a third party who owns or controls rights in Music you uploaded, including claims for performance, mechanical, or needletime royalties that were not properly disclosed to ENKORE.
This Agreement is governed by the laws of the Republic of South Africa. Any dispute will first be referred to good-faith negotiation between the parties and, if unresolved, falls within the jurisdiction of the courts of the Western Cape Division, Cape Town, without prejudice to any right you have to refer a consumer dispute to the National Consumer Commission or an accredited consumer ombud under the CPA.
14.1 Amendments — ENKORE may update these Terms from time to time. Material changes will be posted on the Platform and, where reasonably practicable, notified to you by email at least 30 days before taking effect. Continued use of the Platform after that date constitutes acceptance.
14.2 Severability — If any provision of this Agreement is found unenforceable, the remaining provisions continue in full force and effect.
14.3 Assignment — ENKORE may assign this Agreement in connection with a merger, acquisition, or sale of assets. You may not assign this Agreement without ENKORE's prior written consent.
14.4 Entire agreement — This Agreement, together with the Privacy Policy, constitutes the entire agreement between you and ENKORE regarding the Platform.
14.5 Contact — Questions about these Terms can be directed to info@fanbaseafrica.co.za.
The ENKORE Partner Program lets people and ministries who introduce Musicians to ENKORE earn rewards. It is separate from your use of the Platform as a Musician or Fan. These terms apply to Community Partners and Ministry Partners ("Partners").
Joining — To join, you must have put forward 5 different musicians (as a fan nominating them, or as a Musician referring them) who have each confirmed their own email address, and you must be logged in with a verified email address.
15.1 Community Partners — A Community Partner earns R100.00, once off, for each Musician they refer who is approved by ENKORE and becomes a paying subscriber. The reward is earned once the Musician's first subscription payment has cleared and 30 days have passed. If that payment is refunded within the 30 days, the reward is reversed. A Community Partner earns no ongoing share of subscriptions or sales. Rewards are paid monthly.
15.2 Ministry Partners — A Ministry Partner must be a registered church, ministry or faith-based non-profit organisation, and we ask for an NPO or PBO number, or a letter on church or denomination letterhead. We pay only into the organisation's bank account. A Ministry Partner earns the same R100.00 once-off reward and 1% of the value of the product sales (music and merchandise) of the Musicians they refer. ENKORE pays this from its side, so the Musician's rates do not change. Bookings, tour pledges, and tips or donations never count, and ticket sales and supporter subscriptions count only where ENKORE says so on the Platform. For music sales, the 1% stops for the rest of a Musician's cap year once the Musician reaches ENKORE's annual commission cap (Section 5), because ENKORE earns no commission after that point. A refunded or reversed sale reverses the matching 1%. Rewards are paid quarterly, at the end of March, June, September and December, with a statement of the Musicians and sales counted.
15.3 Minimum payouts — A balance below R500.00 carries over to the next payout.
15.4 Fair use — Each Musician counts for one Partner only: the first referral code or link used is the one that counts. A Partner cannot refer themselves, and a Partner's payout bank details must not match those of the Musician they refer. Rewards are earned only on Musicians that ENKORE approves, and review takes 3 to 14 working days. ENKORE may withhold or reverse rewards obtained in breach of these terms.
These terms apply to Musicians accepted into Season of Singing. They add to the rest of these Terms and do not replace them; where this Section is silent, the rest of these Terms applies. You agree to them when you tick the box on the Season of Singing application form, and they bind you once you are accepted.
16.1 Places — Season of Singing is open to the first 100 active Christian and gospel Musicians and DJ/Producers that ENKORE accepts. Applications close on 31 October 2026, or when all 100 places are accepted, whichever comes first. Applying does not guarantee a place.
16.2 The free term — Your free term lasts 3 months from the day ENKORE accepts you. During it, ENKORE charges no subscription fee and takes 0% ENKORE commission on your sales.
16.2A What is deducted — During the free term, the only deductions from your sales are the fees charged by the payment providers PayFast and Kyshi (whose checkout is secured by Paystack). Payment-provider commissions range from 2% to 3% of each sale. ENKORE takes no commission and makes no other deduction. This applies instead of the deductions listed in 5.4 for sales made during the free term.
Merchandise works as it always does: the item's base price (what it costs ENKORE to make and send it) is the price of the item itself, not a deduction, and you keep everything you charge above it.
16.3 Limits during the free term — To keep onboarding 100 Musicians manageable, these limits apply during the free term only:
Bookings are open from the start of the free term. These limits do not apply to the paid plans.
16.4 Payouts — During the free term, ENKORE pays out your earnings every 14 days to your nominated bank account, once your payout details have been verified.
16.5 What we ask of you — You agree to give ENKORE constructive feedback once a month during the free term (3 times in total), using a short form we send you. If you miss a month, we will remind you. If you miss two months in a row without replying, ENKORE may end your Season of Singing place early. You also agree not to make fraudulent, self-dealing or artificially inflated sales to take advantage of the 0% commission, and to remain an active Christian or gospel Musician in good standing under these Terms throughout the free term.
16.6 When the free term ends — You will be asked to move onto a paid plan. Mainstage is selected for you by default, and you may choose Soundcheck or Headliner instead. Nothing is charged automatically; you choose and pay for a plan yourself. If you pay before the free term ends, your paid plan starts when the free term ends. If you do not choose a plan, your page stays up but sales pause until you do.
16.7 Ending a place early — ENKORE may end a Musician's Season of Singing place early for a breach of this Section or of these Terms, or for fraudulent or abusive use of the 0% commission. The Musician then moves to the standard terms of a paid plan, or, for a serious breach, loses access to the Platform. ENKORE will not charge commission afterwards on sales made in good faith during the free term.
